This paper examines the ambiguities in Montesquieu's account of the British Constitution paying particular attention to the role of history in the development of parliamenatary sovereignty in Britain. We argue that Montesquieu is much more critical of British constitutionalism than is typically supposed, and that his version of an ideal or best regime would be an "Anglo-Gothic" constitutional order combining the British principle of horizontal separation of powers with the Gothic principle of a vertical devolution of power. |
