Justice Lost! Why Bad States Do Good Things (But Why It May Not Matter)

If governments are being socialized by the human rights legal regime to believe something new about human rights norms, either they are not learning to better respect human rights, but rather to understand that repression in the face of commitment to international law is acceptable behavior, or socialization to new beliefs is irrelevant in the face of leaders’ political incapacity to reform. “Bad” states do “good” things by joining international treaties, promising to defend human rights but, by and large, it doesn’t seem to make any difference, even a decade after commitment. If anything, they are learning that doing nothing to improve practices is acceptable behavior.

the time of ratification, CAT & CCPR

All told, these graphs suggest an alarming trend. If governments are being
socialized by the human rights legal regime to believe something new about human rights
norms, either they are not learning to better respect human rights, but rather to understand
that repression in the face of commitment to international law is acceptable behavior, or
socialization to new beliefs is irrelevant in the face of leaders’ political incapacity to
reform. “Bad” states do “good” things by joining international treaties, promising to
defend human rights but, by and large, it doesn’t seem to make any difference, even a
decade after commitment. If anything, they are learning that doing nothing to improve
practices is acceptable behavior.
