Abstract:

In dominant versions of Anglo-American political theory, there has been little consideration of the role that the state should play with respect to intimate relationships among citizens. Instead, that theory was generally conceived to apply to individuals, taken apart from their relationships. During the last generation, both feminists and civic liberals have criticized this dominant view. However, few efforts have been made to reconstruct the role that the liberal state should play with respect to these relationships.

In the larger work from which this paper is drawn, I seek to construct a theory of the relationship between families and the state that, while paying healthy respect to the values of individual freedom and justice, also supports the goods and values that caretaking relationships should provide in a vigorous democracy. At the same time, I seek to do this without idealizing these relationships.

In this paper, I consider the role that the state should play specifically with respect to intimate relationships among adults. To do so, I use the work of Martha Fineman and William Galston to consider the range of approaches that the state might take, and to illustrate the ways in which important principles that underlie liberal democracy stand in considerable tension when it comes to such relationships. I then develop an approach that seeks to ameliorate the tension among these principles, and to give each of them the respect that it is due. This gives the state a role, albeit a limited role, in supporting relationships among adults.
