Abstract:
|
In the year 2000, the European Union passed the ‘race’ directive, requiring its member states to implement Anglo-American style racial anti-discrimination policy. The new institutionalist theory of goodness of fit explains the subsequent implementation of this law in Germany, but not in France.
In order to explain the French exception, I draw on recent fieldwork to compare the national reaction to the directive in the two countries. In the end I argue that a more nuanced institutional analysis does explain the French response, even if one considers the impact of other variables, such as interest groups and politics. |

| One European Directive Two Dramatically Different Responses: Explaining the Divergence in French and German Racial Anti-discrimination Policy after the EU Race Directive By Jacqueline S. Gehring Ph.D. Candidate Jurisprudence and Social Policy University of California Berkeley Prepared for Presentation at the Annual Meeting of the American Political Science Association in Washington D.C. September 2005 Introduction In the year 2000 the European Union issued directive EC/2000/43 also know as the “race directive ” a law that is remarkably similar to |
| although it does force all member states to enact basic anti- discrimination law. Without a strong agency or other mechanism to enforce the law however it may remain an empty promise on the books in many European countries. On the other hand in countries wrestling with the problems of racism within their societies the directive provides an opportunity to improve anti-racism policy and to push the state beyond old policies. Thus the implementation of the directive makes clear both |
