Varieties of Cooperation: Domestic Politics and Transnational Market Governance

Abstract
The rise of transnational markets for information goods has triggered far-reaching international regulatory cooperation among jurisdictions. Intriguingly, such cooperation is characterized by a great deal of organizational diversity. In some instances, regulatory cooperation proceeds through international organizations and treaties; in others, it is based on loose transgovernmental cooperation by domestic regulatory agencies. Certain issue areas remain under the direct control of public officials; others have seen delegation to the private sector. This paper examines the causes of such “varieties of cooperation” in transnational market governance, and argues that the structure of domestic market regulation in the largest market critically shapes both the organizational form and substantive policy agenda for nascent regulatory cooperation. Hypotheses derived from the model are evaluated in case studies of regulatory cooperation in transnational markets for intellectual property, securities, and Internet domain names.
