Abstract:

The paper examines the importance of enforcement mechanisms in agreements regulating
river resources. The paper compares compacts signed between different states in the
United States and treaties signed between countries. One argument that is often made in
international relations literature is that the absence of a centralized government makes it
difficult to reach agreements and even more difficult to enforce these agreements. In the
United States the federal government is available to enforce agreements, which sets these
agreements apart from international treaties. By examining instances in the federal
system when agreements fail to accomplish their objective we hope to illustrate that the
presence of a centralized enforcement mechanism is not a necessary condition for a
successful agreement. We will also examine how countries have been successful in
drafting treaties without a centralized government. |
