Abstract:

This paper is an analysis of the concept of military intervention in the domestic affairs of states and the implications of its normative development for international security in general and for the North-South cleavage in particular. It is concerned with the interplay between international politics and international law, and the normative trends of legitimization of specific justifications of military interventions. More specifically, it examines the concept of anticipatory self-defence before and after the ?Bush Doctrine.? It inquires whether the normative developments regarding the pre-emptive action against terrorism and the threat of weapons of mass destruction thus far have rendered the prohibition on the use of force and the principle of nonintervention reinterpreted or ineffective. In this context, the paper aims to analyze the impact of the contending interpretations of ?self-defence? on the North-South gap as well as the repercussions for international security in general
