Legal change appears as another significant influence and this paper focuses on defamation law and news production and considers how defamation law attempts to take news production practices into account. US and Australian cases have created, and continue to draw on, models of journalistic practice, which appear to be aimed at lessening any ‘chilling effect’ of defamation law on media speech. The authors argue for an interdisciplinary, comparative approach to understanding the different legal regimes and their effects within news production. They outline an object of study that has legal and sociological value and position it within existing literature in each field.

Practices of media news production are transforming under processes of globalising
ownership, technological convergence and an increasing emphasis on profit
maximisation. Legal change appears as another significant influence and this paper
focuses on defamation law and news production and considers how defamation law
attempts to take news production practices into account. US and Australian cases
have created, and continue to draw on, models of journalistic practice, which appear
to be aimed at lessening any ‘chilling effect’ of defamation law on media speech. The
authors argue for an interdisciplinary, comparative approach to understanding the
different legal regimes and their effects within news production. They outline an
object of study that has legal and sociological value and position it within existing
literature in each field.
