Law and Industrial Relations in Luhmann's World Society

Abstract:

The paper addresses two issues in Luhmann’s theory of law and society. First it reconstructs the shifts in focus from function to autopoiesis to evolution in his three major works on law (A Sociological Theory of Law (Rechtssziologie, 1972), Law as a Social System (Recht der Gesellschaft, 1993) and the role of law in Gesellschaft der Gesellschaft, 1997). Second the paper discusses the industrial relations system as a second immune system of society next to law that has a specific function in solving collective disputes. By using Luhmann’s criteria for analysing the autopoietic nature of the economic system, the industrial relations system is conceived as a fully-fledged autopoietic function system of modern society.
