Abstract:

This paper examines alternative hypotheses about the role of flexibility provisions in the negotiation and design of multilateral environmental agreements. It tests one of the Rational Design project's most central hypotheses, that flexibility is related to uncertainty, severity of distributional problems, and the number of relevant actors. It juxtaposes that theory with realist and constructivist understandings of design. It evaluates these hypotheses using a multi-method approach, including process tracing and quantitative comparative analysis. The paper concludes that, while there is substantial support for the Rational Design project's hypotheses, their explanations are necessarily incomplete without the insight of theories based on power and socialization.
