Abstract:

This paper offers an historical institutionalist examination of concurring opinion writing on the Supreme Court in the early 20th century. In particular, the paper looks at the Taft Court (1921-1930)—a body known for its congeniality and unanimity of opinion—and asks: what historical and institutional factors can help account for this phenomenon? To answer this question empirically, the authors examine institutional politics and the role of law in the Taft Era, historical commentary on separate opinions, quantitative changes in concurrence, and the substantive content of all concurring opinions during this era. |
