This paper considers some of the political issues at stake when critics of extraterritorial situations like the US detention facility in Guantanamo Bay invoke a ‘legal black hole’ or ‘legal vacuum’ and call for the application of human rights law to remedy this problem. What is being suggested about the role of the law in relation to such situations, and is it legally correct and politically supportable? Can human rights law deliver all that is being expected of it? Given these considerations, what value is there to Guantanamo’s pre-eminent status amongst the concerns of many human rights activists? |
