Physical and Sexual Abuse Histories in Mitigation

Abstract:

The purpose of the current study was to examine the specific circumstances under which presenting a defendant’s physical or sexual abuse history would be interpreted by jurors as mitigating circumstances for the defendant. This study utilized a between-subjects 2 (type of abuse) X 2 (length of abuse) factorial design. Results thus far reveal that jurors do not distinguish a difference between a defendant’s experience of physical or sexual abuse in their sentencing decisions F(1, 139)=.22, p>.05. It appears that the severity condition (3 months versus 9 years of abuse) was not strong enough to elicit differential sentening from jurors, F(1, 139)=.00, p>.05. However, results have indicated that the subject variables are impacting the sentencing decisions. Specifically, the jurors’ own histories of sexual abuse significantly reduces their support for the death penalty, F(1, 139)=3.79, p=.05.
