Law and Governance of the Socialist State: Re-Reading Pashukanis

Abstract:

Following his critique of bourgeois law in General Theory of Law and Marxism from 1924, Evgeni Pashukanis publishes several polemical texts that call for a formulation of a systematic theory of law of the socialist state. Because it expresses capitalist relations of production, the legal form of the bourgeois state for Pashukanis conceals and legitimates class inequality. In order to eradicate the alienated nature of social relations mediated by commodity exchange under the capitalist mode of production, we need to eliminate not only the individual as a legal abstraction—the bourgeois legal subject with its individual rights and duties—but also craft a kind of state governance in which the “legal form as such would disappear.” This paper will explore what is at stake in this vision of a state without the law: while instrumentalizing the coercive capacities of the law towards the violence necessary to eradicate class inequality, the Soviets also conceived of alternative tools of subject formation and productive social governance to forge a social whole.
