Black Death Penalty Trials: Historical Reflections on Law, Justice and Social Control

Abstract:

Death penalty trials involving black offenders are analyzed to explore the changing nature of race control and (in)justice throughout American history. Trial transcripts, appellate decisions, newspaper accounts and a variety of other sources—including the Papers of the NAACP: Discrimination in the Criminal Justice System, 1910-1955—are analyzed to provide an overview of the context, crime, arrest, trial and punishment of black offenders in seven cases. These trials, dating back to the eighteenth century, demonstrate that black offenders were subjected to slave-based conceptions of law, justice and social control well into the twentieth century. Wrongful convictions and discriminatory justice were common currency and the foundation of American courts, leaving black offenders with an expedited path to the gallows.
