Abstract:

Across the United States, criminal defendants found incompetent to stand trial too often spend many days in jail awaiting placement at a state hospital. Yet many defendants can be safely restored to competence in the community, conserving state resources and maintaining a more natural setting. Some states have a good track record of restoring juveniles or adults in local communities (or jail) rather than in a hospital. This session will review the legal parameters of community-based restoration and share data about successful programs in several states. It will identify barriers to increasing community-based restoration and propose approaches to reduce those barriers.
