Attorney endorsement of defense approaches for juvenile clients: The guardianship and zealous advocacy models

Abstract:

This study examined attorneys’ endorsement of views aligned with the zealous advocacy and guardianship models of defense with juvenile clients. 100 defense attorneys responded to a questionnaire about juvenile competency and models of defense. Results showed that attorneys endorsed aspects of both models in defending juvenile clients, and responses generally did not vary on the basis of defending a juvenile client in juvenile vs. criminal court. Endorsement of the guardianship model was not related to attorneys’ rating of the importance of juvenile trial capacities or enhanced procedural protections in juvenile court. Implications of these preliminary findings are discussed.
