Abstract:

Religion can influence many aspects of a person’s life; support for laws and legal decisions are no exception. Religious characteristics (e.g., fundamentalism, questism, devotionalism) are related to support for many laws including gay rights, invitro fertilization, assisted suicide, safe haven laws, and abortion. Further, religion can affect the legal process. An individuals’ religion is related to support for the death penalty, death qualification, and verdicts and sentencing decisions. Additionally, religious characteristics of defendants and offenders can affect parole decisions, verdicts, sentencing decisions, and perceptions of insanity. Religious arguments given by lawyers also affect jurors. Finally, judges sometimes make decisions regarding their perceptions of how religion does (or does not) affect jurors, for instance whether jurors are influenced by religious arguments from other jurors and attorneys.
