Forgotten Victims: The Role of Transitional Justice Mechanisms in Restoring the Developmental Potential of Children in States with Gross Human Rights Abuses

Abstract:

Gross human rights abuses are commonly viewed as crimes against humanity as a whole. Yet, the literature addressing the transitional justice mechanisms of gross human rights abuses is almost exclusively adult-centric. Across the transitional justice literature, any discussion that involves the impact of transitional justice tools relative to children deals primarily with the challenge of child soldiers. Scholarly literature that addresses the impact of transitional justice tools in restoring the developmental prospects of all children exposed to gross human rights violations is still developing. Of specific interest to this project are the following questions: Is there a potential for current methods of transitional justice to have a positive impact in restoring the developmental potential of children to their pre-human rights abuses levels? It is the premise of this literature review that children have distinct challenges and needs in the face of gross human rights violations and that trials, as a tool of transitional justice, can play a positive role in restoring the developmental prospects of children born in states that have suffered human rights abuses.
