Abstract:

In Carey v. Wolnitzek, (decided July 13, 2010) the Sixth Circuit Court of Appeals recently ruled that some portions of Kentucky's laws regulating speech of state court judicial candidates was unconstitutional. Currently, the United States District Court for Southern Ohio is considering a broader challenge to Ohio's regulation of judicial candidates, including the questions of whether party affiliation can appear with the names of judicial candidates on general election ballots. As a current judicial candidate (for the Ohio Court of Appeals), I am one of the plaintiffs in this case. My paper will examine the reasoning for both rulings and examine their impact on judicial elections in Ohio and Kentucky.
