Abstract:

Understanding and applying rights in various educational settings is complex. While the US has not been a signatory to many of the international human rights declarations, rights are ensured through a variety of state and national laws. This paper discusses the relationship and contradictions between the right to education in US contexts and comparing this with the right to education (as defined by former UN Rapporteur of Education Rights, Katarina Tomeseviski’s 4A Framework). The study specifically examines the rights of refugees and undocumented students in American schools in a highly charged anti-immigration political context.
