Abstract:

The courts in England and Wales have developed surprising flexibility in managing complex multi-party litigation. This paper analyses contrasting recent cases in the environmental and financial services sectors, which illustrate first procedural flexibility and secondly the inter-relation between compensation litigation and regulatory systems and their public enforcement.
