Abstract:

This work in progress aims at empirically assessing securities enforcement across Latin American jurisdictions. Based on the theories suggesting that corporate and securities enforcement spur capital market development and economic growth, the proposed study answers the literature’s call for more empirical data and scholarship, on the, rather unknown, benefits (or lack thereof) of enforcement across jurisdictions. The project inquires on the level of financial regulatory intensity in each jurisdiction of study, and on what accounts for variation in intensity across these jurisdictions. Each country's institutional design and its implementation will be assessed to determine financial regulatory intensity and variation. This comparative case study approaches different Latin American countries with similar institutional enforcement designs, but with expected differences in their implementation and level of regulatory intensity. It covers a period of study during the past decade, when securities enforcement, corporate governance, and market development became more visible in the region. Adding new perspectives to the ongoing discourse, the study centers on measuring enforcement in terms of “enforcement activity”. Moreover, focus is set on an emerging region with widespread support for financial development, but with a hostile corporate environment, that could benefit from a better understanding of securities enforcement.
