Abstract:

To provide input to the design of the next phase of justice sector reform in Serbia a review of the criminal case process has been conducted to identify options for access enhancing efficiency and effective delivery of different levels of legal aid. The methodology applied combines a review of the current and proposed legal framework with expert interviews and process observations to develop a functional flow chart of case processing and decision making from initial police contact through the final court decision. This information was the reviewed in combination with available case and resource allocation data and sample case file reviews to allow for triangulation of interview and observation data. This allows for identifying inefficiencies or gaps in resources allocation that contribute to delays. It provides the basis for modeling alternative processes, their potential impact and resource requirements. Mapping the process also allows for clearly identifying at what stages in the process access to legal aid is being provided, where it would be needed, and what level of legal aid would be needed at what stage.
