Evaluation of Sex Offender Registration and Community Notification Law in Korea: Balancing the Right of Individuals and Demands for Public Awareness

Abstract:

Youth Sexual Protection Act of 2000 in South Korea mandated that Korean Commission on Youth Protection (KCYP) release to the public the names of convicted sex offenders who have victimized children. The law has been changed several times, and currently, the law allows public access to sex offenders’ personal information via public notification law. In addition, the employment restriction on sex offenders is implemented in 2005. Scholars suggested that the community notification law in Korea was the result of exaggerated concerns stimulated by extensive media attention on a few cases against children. Legislation is often the natural outcome of public moral panic, since public demands that some action should be taken to address the problem. Although scholars have been discussed on the impact of notification laws and the constitutionality of such laws, empirical evaluation studies are rarely conducted. The process and outcome evaluation of sex offender registration and community notification law in Korea will be discussed with particular attention paid to the balancing between the right of individuals and demands for public awareness.
